The FMCSA emphasizes the importance of maintaining the integrity of electronic records to enhance road safety and has provided extensive training to enforcement officers to assist in identifying and managing instances of tampering.

An increase in detected violations has prompted authorities to act more decisively against drivers who falsify hours-of-service records. Such violations can lead to citations, immediate removal from service, and further penalties. The American Trucking Associations (ATA) supports efforts to eliminate fraudulent ELD providers and advocates for improved roadside inspection capabilities to identify faked records. Moreover, there is a call for stringent scrutiny during safety audits, particularly for new entrants to the industry, to prevent bad actors from gaining entry.

Experts, such as Jeremy Disbrow from the CVSA, delineate that a distinction exists between unintentional mistakes made by drivers and deliberate tampering actions that involve modifying device settings and falsifying accompanying documents. This intentional manipulation is targeted by proposed new out-of-service criteria, ensuring that lawful drivers are not unjustly penalized.
