CBP Launches Phase 1 of IEEPA Refund System

On April 10, U.S. Customs and Border Protection (CBP) announced that the first phase of CBP's International Emergency Economic Powers Act (IEEPA) refund processing tool, Consolidated Administration and Processing of Entries (CAPE), is expected to launch on April 20. This development comes as a welcome relief for importers who have been waiting for a streamlined process to recover IEEPA duties paid on imported goods.

The new system is designed to consolidate refunds of IEEPA duties, rather than processing refunds on an entry-by-entry basis. By doing so, CBP aims to reduce the administrative burden on importers and improve the efficiency of the refund process.

According to information from the RV Industry Association, CAPE will provide a simple, step-by-step system where users can submit their requests through an online portal and have easy cases handled automatically by the system. More complex cases are reviewed by a CBP officer before a final decision is made.

Once the request is approved, any money owed to importers as a refund is sent back to them electronically. This electronic payment method aims to reduce paperwork and minimize delays in refunds.

However, despite the launch of CAPE Phase 1, refunds are still not guaranteed due to ongoing efforts by the administration to reduce final refund amounts. Importers must remain vigilant and monitor their refund status closely.

To ensure a smooth transition into the new system, CBP has launched a landing page for IEEPA duty refunds, providing additional information on CAPE and its application process. The RV Industry Association also offers a comprehensive overview of tariffs currently enacted through its tariff tracker.

Importers are required to maintain an account in the Automated Commercial Environment (ACE) portal and enroll in Automated Clearing House (ACH) to receive refunds electronically. This requirement aims to streamline the refund process and reduce administrative costs.

CBP remains under court order to provide another update on CAPE's development by April 14. The new release does not provide information on Phase 2 or entries that were liquidated more than 80 days ago.

As the industry continues to navigate the complexities of IEEPA refunds, it is essential for importers to stay informed and up-to-date on any changes or updates to the CAPE system.
