Texas court rules against shipper liability in Home Depot/Werner case

In a landmark decision, the Texas Supreme Court has ruled that one who hires an independent contractor is generally not liable for the contractor's torts. This ruling has significant implications for the freight shipping industry.

The case involved Home Depot and Werner Enterprises, which was hired by Home Depot to move freight. The crash that launched the case occurred in April 2024 near Houston, on a frontage road of the Katy Freeway, just west of the interstate 610 loop around Houston. Juwan Smith, an employee driver at Werner, was transporting freight for Home Depot when he crashed with Natalio Garcia at an intersection along the road after reportedly running a red light.

Home Depot was not initially named as a defendant in the case but was added later. The various arguments in the case focus on the term 'duty' and what was Home Depot's 'duty' to ensure a safe driver. Home Depot argued that an existing duty already applies to the carrier and its employee, and that attempts elsewhere to impose liability against the shipper have failed.

The Texas Supreme Court agreed with Home Depot's argument, stating that the plaintiffs' liability theory is not viable because it transforms the commonplace act of shipping goods into a basis for sweeping tort liability untethered from control, conduct, and risk. The court also echoed an earlier decision that 'the existence of a legally cognizable duty is a prerequisite to all tort liability',
